Opportunity to diversify with alcohol sales at farmers' markets
Farmers' market managers and farm winery owners, this is for you! There is a great opportunity to partner and bring your wine to farmers' market customers. It is now legal for farmers’ markets to allow farm wineries to sell wine at farmers' markets in Kansas through a farmers' market sales permit.
A farmers’ market sales permit allows a farm winery licensee, a member of the licensee's family or an employee of the licensee, to sell wine produced and bottled by the licensee in the original unopened container at a farmers' market located at a site approved by the Alcohol Beverage Control (ABC) director. The Jefferson Hill Farm & Winery was instrumental in taking the farmers' market sales permit from an idea to law. Don and Maxine Bryant have been vendors of the Lawrence Farmers’ Market for 14 years; this will be their sixth year selling wine at the market since the bill passed. The Lawrence farmers' market is on Saturdays, 7:00 a.m. to 11:00 a.m. at 818 New Hampshire, April - November lawrencefarmersmarket.com. "More than half of our wine sales are made at the farmers' market in Lawrence," Don Bryant, owner of Jefferson Hill Farm & Winery.
At this time, this permit is not open to distilleries. However, microbreweries in Kansas can sell beer at a farmers' market, but only through their catering ability. This is not common in Kansas currently. For the past couple of years, Free State Brewing Company has catered Cottin's Hardware Farmers' Market. Cottin's Farmers' Market also goes one step further and partners with Iwig Family Dairy, from Tecumseh, Kan., where they help farmers' market guests learn about the special treat of a beer float.

A farm winery licensee may hold a farmers’ market sales permit. Under the permit, the farm winery may sell domestic table wine and domestic fortified wine manufactured by the farm winery in the original, unopened container at a farmers’ market Approved by the Director. [K.S.A. 41-351and K.A.R. 14-11-24] No farmers' market sales permit will be issued for a farmers' market that is located within 200 feet of a church or school, or which is located within a city or county that has not approved the sale of alcoholic liquor at retail.[Subsection (b) and (c) of K.A.R. 14-11-24]
In its application for a farmers' market sales permit, the farm winery must identify the farmers’ market at which it plans to sell domestic wine and the day of the week on which it plans to sell domestic wine. No holder of a farmers' market sales permit shall sell domestic wine at any farmers' market other than the one specified in the application or on any day of the week other than the day specified in the application. Only the holder of a farmers’ market sales permit, a member of the permittee's family who is at least twenty-one years of age, or an employee of the permittee who is at least 21years of age may sell domestic wine at a farmers' market.[Subsection (h) of K.A.R. 14-11-24]
A farm winery possessing a farmers' market sales permit may sell domestic wine in the unopened, original container, during its chosen farmers' market's regular hours, but not before 6 a.m. and not after 12 a.m. [Subsections (a)(3) and (d) of K.S.A. 41 -308a
